Log Files –

As is true of most web sites, we may gather certain information automatically and store it in log files.

This information may include IP addresses, browser type, internet service provider, referring/exit pages, operating system, date/time stamp and clickstream data.

We use this information, which does not identify individual users, to analyze trends, to detect fraud, administer the site, to track user’s actions around the Site and to gather demographic information about our entire user base.

A pixel tag is a transparent graphic image, sometimes called a web beacon or tracking beacon, placed on a web page or in an e-mail, which indicates that a page or e-mail has been viewed. We do not link Personal Information provided to us through the Site to Personal Information. In addition, a pixel tag may tell your browser to get content from another server.

Generally, we do not ask for or require any sensitive personal data related to recruitment (such as health status, sexual preference, or political beliefs) and will solely use the information you provide to communicate with you and manage your application process.

If you prefer not to have your Personal Data collected, please refrain from submitting it.

 

How we use the Information we collect

This part is relevant to individuals who are citizens of a country within the European Economic Area (“EEA”). It outlines our sincere attempt to fulfill our responsibilities under the General Data Protection Regulation (GDPR).

For the purposes of our Privacy Policy, the “data subject” is “you” (“your”, “user”). The personal data we collect may include, inter alia, IP Address and a unique User ID we may assign to you, as described in this privacy policy.

The personal data we collect will only be used and disclosed for the purposes detailed in sections 3 and 4 to this Privacy Policy.

Our basis for processing personal data: GDPR Article 6.1(a): “the data subject has given consent to the processing of his or her personal data for one or more specific purposes”; GDPR Article 6.1(b): “processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract”; GDPR Article 6(1)(f): “processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party…”

This Section applies to you if you are a natural person/consumer who is a resident of one of the states mentioned in this section, inter alia, California resident as defined in the applicable laws and regulations.

    5.3.6 Categories of third parties to whom Personal Information has been disclosed for a business purpose:

o   Data Analytics Providers.
o   Operating Systems and Platforms.

In the preceding twelve (12) months, we have not sold personal information.

We also do not use or disclose any sensitive Personal Information for purposes other than those authorized by you or as permitted by law.
     5.3.7 Your Rights 
You may be entitled to the following specific rights under the CCPA and the CPRA regarding your Personal Information:
You have the right to opt-out of the “selling” or “sharing” of your Personal Information.
You have the right to opt out of “targeted ads” or “profiling,” as these terms are defined under the privacy laws.
You may have the right to request, twice in a 12-month period (depending on the law in your state), the following information about the Personal Information we have collected about you during the past 12 months:

the categories and specific pieces of Personal Information we have collected about you; 2. the categories of sources from which we collected the Personal Information; 3. the business or commercial purpose for which we collected the Personal Information; 4. the categories of third parties with whom we shared the Personal Information; 5. the categories of Personal Information about you that we disclosed for a business purpose, and the categories of third parties t whom we disclosed that information for a business purpose.

You are also entitled to ask us to erase or update any Personal Data we have obtained from you.

To safeguard your privacy and ensure security, we implement measures to confirm your identity before providing access to data or fulfilling any such request. Where allowed by applicable legislation, we may impose a reasonable charge to process your request.

Right to Equal Treatment and Freedom from Retaliation When Exercising Privacy Rights: You are entitled to make use of your privacy rights without being subjected to unfair or retaliatory actions. Exercising your rights—such as opting out of the sale or disclosure of your Personal Data—will not result in less favorable treatment compared to individuals who choose not to exercise those rights.

 

5.4 Additional Rights and Provisions for Colorado, Connecticut and Virginia Residents
This section applies to Colorado, Connecticut and Virginia Residents as defined by the Colorado Privacy Act (“CPA”), Connecticut Data Privacy Act (“CTDPA”), and Virginia Consumer Data Protection Act (“VCDPA”). Capitalized terms defined in the CTDPA, CPA, VCDPA that are used in this section shall have the same meaning as in the CTDPA, CPA and VCDPA.

This section describes our collection, use, and disclosure of personal information. You can learn more about the personal information we process, how we process the personal information, the purpose for processing such personal information and the categories of third parties with whom we share such data, in Sections 5.2 and 5.3. above.

We do not sell personal information (as defined under the CTDPA, CPA, VCDPA) for monetary consideration.

If you are a Colorado, Connecticut, or Virginia Consumer, subject to certain conditions and restrictions set out in the CTDPA, CPA, VCDPA and other applicable laws, you may have certain rights regarding your personal information (as applicable, depending on where you reside), as described below:

We can meet sufficiently verifiable user requests. Sufficiently verifiable user requests refer to requests that allow us to reasonably match the information provided by the user making the request with the information already available with us, insofar non-pseudonymous Personal Information is available.

Any disclosures we provide will only cover the 12-month period preceding receipt of your request.

Data Retention and Deletion

We do not store personal data longer than necessary to achieve the objectives for which it was gathered, or beyond the period required by relevant laws or regulations.

Personally identifiable information, which we collect to deliver our services to Clients or display content to users, is kept for a maximum of twenty-four (24) months following the user’s last interaction with our Platform or Services. After this period, the data will either be anonymized by eliminating distinct identifiers or combined with other data, or it will be completely erased.

We may continue to hold aggregated information, which does not reveal the identity of any individual or device and is used for analytical or reporting purposes, for as long as it remains useful for business operations.

 

Children

The Site and/or Service is not directed to children under 13. We do not knowingly collect Personal Information from anyone under 13 years of age. You agree that the information you provide to Freshtech on registration and at all other times will be true, accurate, current, and complete. You also agree that you will ensure that this information is kept accurate and up-to-date at all times. If You have reason to believe that your account is no longer secure (e.g., in the event of a loss, theft or unauthorized disclosure or use of your account ID, password, or any credit, debit or charge card number, if applicable), then You agree to immediately notify Freshtech. You may be liable for the losses incurred by Freshtech or others due to any unauthorized use of your Site account.

 

Placement of Ads

To qualify as a user of Freshtech (across any supported platform), you must adhere to all applicable terms, including but not limited to the following conditions:
(a) Any websites, associated domains, or content partners must not engage in misleading practices, redirection, or derive traffic from adult-themed platforms to artificially inflate visits.
(b) You are prohibited from promoting through or linking to sites that feature explicit adult content, discriminatory or inflammatory material based on race, ethnicity, or politics, pirated software (e.g., Warez), hacking resources, hate speech, or any other prohibited or inappropriate content.
(c) You are strictly forbidden from displaying any Freshtech advertisements on third-party sites or platforms without prior written approval from Freshtech. Additionally, you must not place ads on pages hosting pornographic or offensive content, warez or illegal music downloads, unauthorized peer-to-peer networks or torrent platforms, or any site containing spyware, malware, or similarly harmful content.

Should any promotional content appear in such disallowed environments, Freshtech retains the full right to deny payment for the entire advertising initiative and/or initiate legal proceedings, as well as seek monetary compensation for any losses or damages incurred as a result.

 

Termination of Publishers and Advertisers

By signing up as a publisher or advertiser, you represent and warrant that the content on your website or in your advertisements or their subject matter does not infringe any third party’s intellectual property rights or facilitate the infringement of such rights.
